Terms of Service

These Terms of Service (“Terms”) govern your access to and use of xbackupman (the “Service”). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

xbackupman schedules, encrypts and verifies backups of your databases, servers and sites, and delivers them to storage that you own and control. We provide the orchestration; you provide the sources and the destination storage.

You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use. You must be at least the age of majority in your jurisdiction to use the Service.

• The Free plan is offered at no cost, subject to the limits shown on our pricing page.
• Paid plans are billed in advance through Stripe on a recurring basis until cancelled. Fees are stated exclusive of taxes, which you are responsible for where applicable.
• You can cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable.
• We may change plan features or pricing with reasonable notice; changes do not apply retroactively to the current paid period.

Backups are a shared responsibility. You are responsible for configuring your sources, schedules, retention and storage correctly, for providing valid credentials, and for periodically testing that restores meet your needs. Because backups are written to storage you control, you are responsible for the availability, durability and access controls of that storage.

You agree not to:

• Use the Service to back up data you have no right to process.
• Violate any law, infringe others’ rights, or transmit malware.
• Attempt to breach, probe or disrupt the Service, or circumvent usage limits, tenant isolation or authentication.
• Resell or provide the Service to third parties except as expressly permitted.

You retain all rights to your data and your backups. You grant us the limited permissions necessary to operate the Service on your behalf — for example, to connect to your sources and write encrypted backups to your storage. We claim no ownership over your content. Our handling of personal data is described in our Privacy Policy, and processing on your behalf is covered by our Data Processing Addendum.

The Service integrates with third parties you choose (such as your storage provider) and that we use to operate (such as Stripe for payments and our hosting and CDN providers). Your use of those services may be subject to their own terms.

We work hard to keep the Service reliable but do not guarantee uninterrupted availability. We may modify, suspend or discontinue features, and may perform maintenance that temporarily affects scheduled jobs.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that backups will be error-free or that any particular restore will succeed; verification reduces but does not eliminate risk.

To the maximum extent permitted by law, xbackupman will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, revenue or profits. Our total liability for any claim arising out of or relating to the Service is limited to the amounts you paid us in the twelve months preceding the claim.

You agree to indemnify and hold xbackupman harmless from claims arising out of your data, your use of the Service, or your breach of these Terms.

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to others or to the Service. On termination, your right to use the Service ends; your backups remain in your own storage.

We may update these Terms from time to time. Material changes will be announced in the app or by email. Continued use after an update constitutes acceptance.
